You’re Not Always In Such Good Hands with Your Insurance Company
People want to believe their insurance company will take care of them when it comes time to file a claim. The truth is, though, when you file against your homeowner’s policy, underinsured motorist policy (UIM), or uninsured motorist policy (UM) your insurance company will treat you like every other claimant. They will try often try to deny or minimize your claim. Their bottom line suddenly becomes more important than treating you like a good neighbor.
Your insurance company owes you a duty of good faith in handling your claim. If they fail to negotiate in good faith, we can sue not only for the underlying claim, but for bad faith and punitive damages.

Denied Life Insurance Claim? You Have the Law On Your Side.In South Carolina, a life insurance policy, like any insurance policy, “has to be liberally construed in favor of coverage.” Torrington Co. v. Aetna Cas. and Sur. Co., 264 S.C. 636, 216 S.E.2d 547 (1975). If your claim was denied or canceled, here are some of the legal options we can pursue on your behalf:
- We may elect to treat the policy as still in force, and let the test of the validity of the cancellation or repudiation await until the policy is payable and sued on.
- We may sue in equity to set aside the cancellation, and to have the policy declared to be valid and in force.
- We may maintain an action at law to recover damages for the wrongful cancellation or repudiation.
Why Was Your Valid Claim Denied? It’s important to remember that the law is almost always construed in favor of the policy. The insurance adjustor will find every technicality to show that your claim was inflated or that the policy did not cover your specific circumstances. Some companies practice in bad faith, denying or delaying claims, hoping you give up. Just because it’s your own policy doesn’t mean you don’t need an aggressive fighter on your side.
Can You File Against More Than One Policy? Yes, you can often stack coverage to file for money damages against another party’s policy, as well as your own. This is often the case when you suffered injuries or financial losses by a criminal act. We look for every available money option for our clients.
